Madras High Court Restrains Election Commission From Notifying Five Tamil Nadu Bypolls

The Madras High Court has restrained the Election Commission from notifying by-elections for five vacant Assembly constituencies across Tamil Nadu where election petitions are currently pending. The judicial order, issued at the high court in Madras, puts a temporary halt on the electoral process for the seats of Madurantakam, Dharapuram, Ambasamudram, Perundurai, and Viralimalai.
According to the High Court's directive, the Election Commission is barred from announcing the poll schedules for these five constituencies until the pending election petitions are formally disposed of by the judiciary. This ruling directly impacts the timeline for filling the legislative vacancies in these regions.
Out of the six vacant Assembly seats currently awaiting by-elections in the state, Tiruchirappalli East is the sole constituency that remains unaffected by the High Court's ruling. The Tiruchirappalli East seat became vacant after Chief Minister Vijay decided to vacate it, having secured a victory from the Perambur constituency.
In contrast, the vacancies in the other five constituencies—Madurantakam, Dharapuram, Ambasamudram, Perundurai, and Viralimalai—were created after All India Anna Dravida Munnetra Kazhagam (AIADMK) Members of the Legislative Assembly (MLAs) resigned from their positions.
The suspension of the by-election notifications has significant political implications in Tamil Nadu. Major political organizations, including the ruling Dravida Munnetra Kazhagam (DMK), the opposition AIADMK, and the Tamilaga Vettri Kazhagam (TVK), have all been actively gearing up for these crucial electoral contests.
The High Court's decision represents a notable setback for the former AIADMK legislators who chose to resign from their Assembly seats. These former lawmakers had resigned in the hope of seeking a fresh mandate and contesting again in the by-elections, a plan that is now delayed due to the pending court petitions.
No timeline has been specified for the resolution of the pending election petitions. Until these legal matters are fully settled in court, the Election Commission cannot take any steps toward initiating the democratic process in the five affected constituencies, leaving only Tiruchirappalli East on the active electoral path.
