Delhi High Court Overturns Acquittal in 2013 Sexual Harassment Case

The Delhi High Court has overturned the acquittal of a man accused of sexually harassing his teenage neighbour in 2013, setting aside a previous verdict that cleared him of all charges.

The accused had been cleared of all charges in 2014 following a trial in which the complainant's apparel and character were subjected to scrutiny and attacked during cross-examination. In its decision, the High Court rejected and dismissed the justifications given in the earlier verdict.

Justice Sudha Chandrasekaran stated that the suggestion that a woman wearing jeans may corrupt young boys reflects a deeply troubling and unacceptable mindset. The ruling noted that the culture of misogyny itself must be held accountable rather than placing the focus and blame on the survivor.

The High Court observed that parents and society must teach their children to control their conduct rather than policing women's apparel. The judgment emphasized the responsibility of parents to ensure misogynistic attitudes are not passed down or excused when learned by boys.

The court highlighted that the onus in all instances of misbehaviour rests firmly on the perpetrator and those who shape an individual's conduct, directly countering practices where the upbringing and character of a girl or woman are questioned following an offence.
